TransitNext M&R is a wholly owned subsidiary of AtkinsRéalis O&M. TransitNext has been awarded a 27-year contract to maintain the Trillium Line, the newly extended diesel rail transit system in Ottawa designated as Lines 2 and 4.

The Contract Manager is responsible for the ongoing oversight and management of all subcontracts related to maintenance and rehabilitation services.  The Contract Manager will be a key interface with TransitNext and the client in relation to contract interactions.  They will be responsible for Contract guidance to Managers in dealing with contract matters.  Working with management, the Contract Manager will monitor and address contractor performance, compliance, and issues to ensure TransitNext’s maintenance and rehabilitation services are in compliance with Project Agreement requirements and client expectations.  The Contract Manager will also have responsibility for warranty claims, Variation Notices and directly involved in new contract negotiation as well as procurement processes.

Your role within the team:

  • Responsibility for the implementation of the procurement strategy of TransitNext.
  • Defines the terms and conditions of the TransitNext subcontracts.
  • Overall responsibility in preparation of the terms and conditions for the different types of TransitNext procurement models (back-to-back, services, goods, etc).
  • Development and Guidance for TransitNext Procurement Policy and Procedures.
  • Provides legal and commercial support to the Maintenance Director.
  • Supporting role to the Maintenance Director with regards to Project Agreement, Interface Agreement (IA) and Maintenance and Rehabilitation (M&R) contract claims.
  • Responsibility for the management of subcontractors’ claims.
  • Responsible for the working level day to day interface with the client with respect to ongoing contract matters, including Daily, Weekly, Monthly Performance Review Meetings.
  • Developing and preparing commercial correspondence on behalf of the Maintenance Director.
  • Responsible for the day-to-day management and oversight of subcontracts related to TransitNext maintenance and rehabilitation services ensuring that all subcontractors are performing as required, that issues and contract matters are promptly addressed, and ensuring that proper records are maintained. These subcontracts include but are not limited to:
    • Vehicle, infrastructure, and systems maintenance subcontract.
    • System wide custodial cleaning subcontract.
    • Elevator maintenance subcontracts
    • Structures inspection subcontract
    • Fire detection and alarm system maintenance subcontract.
    • Facilities mechanical and electrical systems maintenance subcontract.
    • Miscellaneous ad hoc contracts.
    • Responsible for negotiating and entering new subcontracts as directed and required to support the maintenance and rehabilitation services.
    • Responsible to manage contract claims and disputes at a local level and elevate major contractual issues when partnership level support is necessary or may be required.
    • Responsible to initiate and administer warranty claims, variation notices and other related contract processes with TransitNext, the client, and suppliers/subcontractors.
    • Responsible for ongoing negotiations with subcontractors and formalizing agreements and/or pricing arrangements.
    • Responsible to provide support in TransitNext procurement activities, ensuring best life cycle value.
    • Supports the performance management team for issues related to the penalty regime of the subcontracts, including performance with special attention to the Failure Points regime.
    • Prepares the formal communications required by the subcontracts.
    • Manages the interfaces between Subcontractors
    • Participate in TransitNext senior management meetings, providing updates on contract status, issues, improvements, and opportunities.
    • Other duties as assigned.

The ideal candidate:

  • Skills/Knowledge/Experience:
    • Recognized Law graduate in the Province of Ontario or equivalency in education.
    • 3- 5 years of experience on contract preparation/negotiation and/or work in a commercial department.
    • Experience in P3 process in Canada (highly recommended).
    • Experience in Transit Industry (recommended)
    • Experience in selecting, negotiating, and managing subcontractors and service providers.
    • Proactive and self-motivated with the ability to work with limited direct supervision.
    • Highly developed organizational, analytical, problem solving and interpersonal skills.
    • Excellent verbal and written communication skills including commercial, technical, and investigative report writing skills.
    • Proficient working in MS Suite software – Word, Excel, PowerPoint.
    • A combination of experience and education may also be considered.
  • Safety Aspects:
    • This role is not exposed to any high-risk work but the incumbent is expected to follow Company Policy relative to all matters pertaining to safety in an office environment.
  • Environmental Aspects:
    • This role has no Significant Environmental Aspects associated with it but the incumbent is expected to follow Company Policy relative to all matters pertaining to the environment.
