JOB DESCRIPTION

Job Title: Contract Manager

Location: Raleigh, NC

Purpose of the Job:

This role is a Contract Manager supporting the project business for Linxon US, LLC.  The role reports to the General Counsel Americas for Linxon US, LLC.  We are looking for a contract manager with 10-12 years of experience who has worked for employers in the construction industry.  The ideal candidate will have experience advising in connection with engineering, procurement, and construction (EPC) offerings for utility grid infrastructure projects in Puerto Rico and throughout Latin America.    

The successful candidate will provide the US business unit with expert advice on all aspects of its EPC business.  This will include: (i) supporting sales/tender teams in the negotiating and drafting EPC agreements, (ii) advising supply chain management in connection with negotiation/drafting of key supplier subcontracts, and (iii) working with the project implementation organization to manage and resolve project claims.  In addition to the forgoing, the successful candidate will work directly with external legal counsel to ensure the effective and efficient management of any formal dispute resolution (arbitration/litigation).  The selected candidate will work closely with US management, internal clients, engineers, and technical teams to advise on all commercial issues relevant to Linxon’s business. Finally, the successful candidate will be charged with ensuring all commercial proposals/transactions are conducted in accordance with the Company’s policies and rules of governance.

Key Areas of Responsibility (KARs):

  • Support and provide advice to Linxon in all project implementation and contracting matters, but primarily in the areas of subcontracting, equipment procurement, insurance, claims management, and dispute resolution. 
  • Analyze contracts in light of corporate guidelines and policies as well as the commercial and legal risks material to project stakeholders.
  • Providing training with respect to internal Linxon regulations as well as contractual or commercial concepts important to Linxon business interests.   
  • Provide advice and opinions on risks and related commercial issues analysis;
  • Participate in the negotiation process of various contracts with clients, joint ventures, subcontractors and suppliers;
  • Coordinate with legal counsel to interpret laws, decrees and any other documents of a legal nature, ensuring that the interests of the corporation are adequately protected;
  • Participate in the application and follow up of the corporations’ policies, procedures, and internal rules

Experience Required:

  • Member in good standing of a bar association in one of the fifty states of the United States;
  • Fluency in English & Spanish is required, but proficiency in any other languages is a plus;
  • Excellent oral and written communication skills in English and Spanish are a must;
  • Operating in a lead role as a contract manager in the United States, Puerto Rico, and Latin America generally.
  • Supporting utility construction projects or engineering/commercial clients engaged in heavy industrial manufacturing, particularly with respect to projects in Puerto Rico. 
  • Working as part of a small close-knit team in a demanding, fast-paced, multilingual, and multidisciplinary environment;
  • Strategic communication with executive management, customers, and subcontractors/suppliers.   

Other Position-Specific Characteristics:

  • Availability to travel to project sites in the US (including Puerto Rico) and occasional travel to locations in Canada or Europe.
  • Position to be located in Puerto Rico. 

Competencies/ Skills Required:

  • The Contract Manager must possess strong communication skills and excel at collaboration.
  • In crafting and delivering commercial advice, the Contract Manager must be able to maintain their attention to detail while supplying advice that does not lose sight of the broader strategic goals of Linxon.   
  • The Contract Manager must be able to operate independently, make decisions, and help drive projects to conclusion.
  • The Contract Manager must be prepared to directly communicate unpopular information and to hold others accountable, as needed.     
  • The Contract Manager should possess a business-driven, pragmatic mindset, and should understand that good results are achieved through company-wide cooperation, both with our internal and external partners. 
  • The Contract Manager must possess and demonstrate first-hand experience drafting and negotiating EPC turnkey contracts and must have acquire a keen understanding of the risks and issues involved in the same. 

Education Required:

  • B.A., B.S., or Equivalent from accredited College or University are required, but a Juris Doctorate (or equivalent) from an accredited law school in Latin America is a big plus.
